Booking Information & Rental Terms

Our aim is to provide our guests with a relaxing, high-quality and transparent holiday experience at Can Perla. The following Booking Information and General Rental Terms are intended to provide clarity and establish the basis for a pleasant stay and a fair contractual relationship between the Property Owner and the Guest.

PART 1 – Booking Information

1. Booking and Rental Agreement

A binding rental agreement is concluded upon the Property Owner's written booking confirmation and receipt of the agreed deposit. By completing the booking, the Guest acknowledges and accepts these Booking Information and General Rental Terms.

2. Payment Terms

A deposit of 30% of the total rental price is payable within 7 days of the booking confirmation.

The remaining balance must be paid no later than 8 weeks before arrival.

For bookings made within 8 weeks prior to arrival, the full rental amount is payable immediately.

If the deposit or the remaining balance is not received by the due date, the Property Owner reserves the right, after issuing a payment reminder, to withdraw from the rental agreement and re-let the booked period.

3. Included in the Rental Price

The rental price includes exclusive use of the entire finca as specified in the booking confirmation, Wi-Fi, bed linen, bath towels and pool towels, final cleaning, as well as additional blankets during the cooler months.

To enable the final cleaning to be carried out within the usual scope, the property must be left in a reasonably clean condition upon departure. Dishes must be washed and put away, the refrigerator emptied, and excessive dirt and rubbish removed. Any cleaning required beyond normal use or any exceptional soiling may be charged separately or deducted from the security deposit.

Upon arrival, guests are provided with a complimentary starter supply of essential kitchen and bathroom items for the first days of their stay. These include, among other things, toilet paper, hand soap, kitchen roll, washing-up liquid, dishwasher tablets, laundry detergent, and a selection of basic kitchen supplies and consumables.

These items are provided as a welcome starter pack only and will not be replenished during the stay.

The statutory Mallorca Ecotax (Ecotasa) is included in the total rental price.

The rental price also includes normal household electricity and water consumption (excluding pool heating, air conditioning and sauna, which are charged separately), garden and pool maintenance during the stay, and assistance from our local German-speaking property management team.

4. Additional Charges and Energy Consumption

Electricity consumed by the pool heating, air conditioning and sauna is charged separately according to actual consumption. Consumption is calculated based on the recorded electricity meter readings at a rate of €0.50 per kWh. Use of the hot tub (whirlpool) is optional and charged at €90 per commenced week.This weekly fee includes all operating costs, including electricity consumption. No separate meter reading is taken for the hot tub.

All additional charges incurred during the stay will be deducted from the security deposit after departure.

5. Security Deposit

A refundable security deposit of €500 must be paid in cash upon arrival.

The security deposit serves as security for any damage to the property, excessive cleaning requirements, or outstanding additional charges (for example electricity used for pool heating, air conditioning or sauna).
Provided that no damage or outstanding charges are identified, the security deposit will be refunded upon departure or after the final inspection of the property.

Any additional costs or damages will be deducted from the security deposit. The Property Owner reserves the right to retain a reasonable portion of the deposit until any outstanding damages or utility costs have been fully assessed.

6. Check-in and Check-out

Check-in is available from 3:00 pm. Check-out must take place no later than 10:00 am.

Different arrival or departure times may be possible upon prior agreement and subject to availability.

7. Maximum Occupancy and Visitors

The finca may only be occupied by the number of guests confirmed in the booking confirmation. Visitors, additional overnight guests, events, celebrations or parties require the Property Owner's prior written consent. Subletting is strictly prohibited.

Any breach of this provision may result in immediate termination of the rental agreement without any entitlement to a refund.

8. Quiet Hours and Respect for Neighbours

Can Perla is located in a peaceful residential area. Guests are required to respect local quiet hours as well as the privacy and interests of neighbouring properties at all times.

Particular consideration must be given during the evening and nighttime hours by keeping noise to a reasonable level.

9. Care of the Property and Damage

Guests agree to treat the finca, its furnishings and all outdoor areas with due care and respect. Any damage, defects or technical issues must be reported to the Property Owner or the local property manager without delay. Upon departure, all furnishings and equipment must be left complete and in proper condition. Any damaged or missing items must be reported immediately. The costs of replacement or repair will be charged to the Guest and may be deducted from the security deposit.

 

10. Use of the Swimming Pool, Hot Tub and Sauna

The swimming pool, hot tub and sauna are used entirely at the Guest's own risk. Children must only use these facilities under the continuous supervision of a responsible adult. 

The Property Owner assumes no supervisory responsibility.

Guests should exercise particular caution around wet surfaces, as they may become slippery.

11. Smoking, Illegal Activities and Pets

Smoking is strictly prohibited inside the house. Illegal activities, the use of illegal drugs and excessive disturbance of the peace are strictly forbidden. Pets are only permitted with the Property Owner's prior express approval.

Any breach of the no-smoking policy resulting in the need for odour removal or specialist cleaning will be charged to the Guest.

12. Waste Disposal

Guests are responsible for disposing of all household waste generated during their stay in accordance with the local waste disposal regulations.

Should excessive additional work be required due to waste not being disposed of properly, the resulting costs may be deducted from the security deposit.

13. Cancellation Policy

All cancellations must be made in writing. The effective date for calculating cancellation charges is the date on which the written cancellation notice is received by the Property Owner.

The following cancellation charges apply:

  • Up to 43 days before arrival: 30% of the total rental price (equal to the deposit).
  • 42 to 29 days before arrival: 50% of the total rental price.
  • 28 to 2 days before arrival: 80% of the total rental price.
  • Less than 2 days before arrival, no-show, or failure to use the booked accommodation: 100% of the total rental price.

In the event of a cancellation, the Property Owner will make reasonable efforts to re-let the booked period.

Where the property is successfully re-let for the cancelled period, any savings or replacement income will be taken into account accordingly.

The Guest remains entitled to demonstrate that the Property Owner has suffered a lower financial loss than the cancellation charges stated above. In such cases, only the lower amount shall be payable.

Guests are strongly advised to take out comprehensive travel cancellation and travel interruption insurance.

14. Left Property

The Property Owner accepts no liability for personal belongings left behind after departure.

Where forgotten items are found, they may be returned to the Guest upon request, provided that the Guest reimburses the shipping and packaging costs.

 

PART 2 – General Rental Terms and Conditions (Terms & Conditions)

1. Scope of Services

The scope of services is determined by the booking confirmation, the current property description on the website, and any individually agreed services.

2. Liability of the Landlord

The landlord shall be liable in accordance with the applicable statutory provisions. Liability for slight negligence is excluded unless essential contractual obligations have been breached or the damage relates to injury to life, body, or health.

To the extent permitted by law, liability for loss of holiday enjoyment, indirect damages, or consequential damages is excluded.

3. Liability of the Guest

The guest shall be liable for any damage to the rental property or its furnishings caused by the guest, accompanying travellers, or visitors.

The guest undertakes to use the rental property, including all outdoor facilities, with due care and to notify the landlord immediately of any apparent hazards or damage.

4. Technical Failures and Force Majeure

Temporary technical failures affecting the internet connection, electricity supply, water supply, air conditioning, pool equipment, sauna, whirlpool, or other technical facilities cannot be completely ruled out despite careful maintenance. In such cases, the landlord will make every reasonable effort to remedy the problem as quickly as possible. Liability for such temporary disruptions is excluded unless they are caused by intentional misconduct or gross negligence on the part of the landlord or mandatory statutory liability provisions apply.

In the event of extraordinary circumstances (in particular force majeure, government-imposed travel restrictions, natural disasters, or comparable events) that make the use of the rental property impossible, any payments already made shall be refunded in full unless an alternative rental period can be agreed. This provision applies in particular if entry to Mallorca is prohibited by official order on the booked arrival date.

To the extent permitted by law, no further claims for damages, reimbursement of expenses, or compensation shall arise in such cases.

5. Data Protection

Personal data shall be processed exclusively for the purpose of handling the booking and managing the guest's stay.

6. Internet and Wi-Fi Use

Can Perla provides guests with Wi-Fi internet access.

The guest undertakes not to use the internet connection for unlawful purposes. In particular, illegal downloads, the distribution of copyrighted material, and any other unlawful activities are prohibited.

Due to regional and technical conditions on Mallorca, uninterrupted internet availability cannot be guaranteed at all times.

The landlord accepts no liability for temporary interruptions or limitations of the internet connection.

The guest shall indemnify and hold the landlord harmless against any claims or damages brought by third parties arising from unlawful or contractual misuse of the Wi-Fi connection by the guest or accompanying persons. This indemnity also includes the costs of any legal defence.

7. House Rules and Local Regulations

The guest undertakes to comply with the house rules, local legal regulations, and official requirements applicable in Mallorca.

8. Natural Environment

Can Perla is situated within a well-maintained garden and surrounded by a natural Mediterranean environment. Despite regular maintenance and pest prevention measures, the occasional presence of ants, mosquitoes, beetles, spiders, other insects, or typical local wildlife such as geckos and lizards cannot be completely avoided. This does not constitute a defect of the rental property and does not give rise to any reduction in rent, damages, or other compensation claims, unless there is an exceptional infestation.

9. Severability Clause

Should any provision of these Terms and Conditions be or become invalid, it shall be replaced in accordance with the applicable statutory provisions. The validity of the remaining provisions shall remain unaffected.

10. Applicable Law

Spanish law shall apply, unless mandatory consumer protection provisions of the country in which the guest has their habitual residence provide otherwise. To the extent permitted by law, the place of jurisdiction shall be Manacor.
