Booking Conditions
The given prices are valid for each house and with regard to the given number of persons at maximum. The costs for bed linen, towels, gas, electricity and water are included in our price. In case of stays from 10 days onwards, we will change, after each 7 days, bed linen and towels, as well as we will do an interim-cleaning of the house (such a cleaning during your stay will always be available for you additionally, for checking the charge, see price list).
We levy an additional charge for each stay with regard to a cleaning at the end of your stay which is called cleaning of handing over (see price list). We kindly ask you to return the rental house well-swept at the end of your stay.
Generally speaking, our houses for rent have a minimum of renting it of one week (7 days). You can choose any day as your day of arrival. The booked house will be available for you at about 2 o´clock in the afternoon on your day of arrival. If you want to come earlier, please, make an agreement with us first. On your day of departure, we kindly ask you to leave the rental house until 10 o´clock in the morning latest.
If you book one of our holiday houses, you have to pay a deposit of 30 percent of the total price. The balance has to be paid latest 8 weeks before the planned day of arrival (decisive here is the money receivable on our account). If this is not the case, we are entitled to cancel your booking and to rent the house further. You are always entitled to a travel cancellation before the beginning of your journey. With regard to the amount of the produced charges in case of a travel cancellation, it is decisive when this explanation of travel cancellation is received by us.
In case of a travel cancellation, the following charges of travel cancellation are valid:
· in case of a travel cancellation until 43 days before the beginning of renting one of our holiday houses, is 30 percent of the total amount for renting the house (deposit),
· in case of a travel cancellation from 42 days to 29 days onwards before the beginning of renting one of our houses, it is 50 percent of the total amount for renting the house,
· in case of a travel cancellation from 28 days to 2 days onwards before the beginning of renting a house, it is 80 percent of the total amount for renting the house and
· in case of a travel cancellation which has been explained later and in case of non-utilization of the services we agreed on in the contract, it is the total amount for renting one of our holiday houses.
Differently to these estimated charges of travel cancellation, you naturally have the right to establish proof of the fact that there is only a little damage for us. If you present us a suitable substitute tenant or if a further renting out by us, with reference to the same conditions, is possible, the additional costs of the travel cancellation will be dropped for the period of time in which we will have rented out the house further. If this is only possible in case of price reduction, you will have to reimburse the difference for us up to the amount of the rental tariff we agreed on. We highly recommend you to conclude a travel-cancellation-insurance.
You have to pay a bail of 50,00 Euros when you get the keys. We will return this bail if you return the house for rent and the keys according to the rules. Otherwise, the bail will expire. If there is another damage for us (for example in case of having to produce a new key), we are entitled to determine even other fees, not only the bail, on a separate bill.
It is only allowed to live in / use our house for rent with the registered number of persons. Additional persons could be turned down or could be charged separately.
Exclusion of liability
We have made the description of the house for rent by our best knowledge. That is why we will not accept any liability with reference to possible differences. We will not guarantee a certain state of the object for rent nor for its location nor for the opportunities of using it. If there is some influence of the object for rent through force majeure, for example, strikes, war, power or water cuts which are typical for the whole country or thunderstorms, we will not be responsible for that. If using the object for rent, because of force majeure, is not possible nor is it possible to find a substitute object, we will only /at maximum be responsible for the amount of advances paid by the customer / client. Additionally, we will not be responsible for the permanent provision of installations like central heating, pool and so on. We also won´t be responsible for a possible noise pollution caused by the development of the houses / properties next door. Using the holiday real estate, including all installations outside, is at one´s own risk. We are not responsible in case of accidents; unless these accidents were caused by us intentionally. The customer has to care for his or her brought things and valuables on his or her own, as well as for his or her cash. We are not responsible in case of break-ins nor thefts. The tenant will be only responsible if he or one of his fellow occupants cause some damage with reference to our object for rent. You have to inform the local management immediately if there are damages. You cannot assert any compensation claims against the lessor, unless these were caused intentionally by the lessor. The assertion of a compensatory damage because of vacation/holiday time which has been used in vain or because of indirect property damage is impossible.
Normally and mainly, the objects for rent are surrounded by gardens and natural green areas. The tenant has to take ants, mosquitoes and beetles into account. You have to accept such insects, even on the property. This is not any defect. It won´t be able to assert a compensation claim out of this.
For the whole period of rent, the tenant has the duty to maintain safety on the whole property, inclusively on all green areas outside, swimming pool, garage and pavement.
The contract and all services which are based on the contract are subject to Spanish law. This is also valid for all rights and obligations which result from the contract. Place of jurisdiction is Manacor.
